    🎄 ASB Advent Day 2 - Neighbour Disputes 🎄 Let’s not try and fit a square peg into a round hole. Take the housing related defintion of ASB: “Conduct capable of causing nuisance or annoyance to any person”This tells us there must be:✔️ Behaviour that meets the threshold to be reasonably considered anti-social ✔️ Someone who is causing that behaviour ✔️ Someone is impacted by the behaviour ✔️ Credible evidence to the relevant standard of proofNeighbour disputes often do not have these elements:❎ The issues reported do not meet the threshold to be ASB (even when applying a harm centred approach)❎ There isn’t a clear victim or perpetrator. A dispute can be defined as ‘a heated exchange of differing views’. Both parties have to be contributing to be a ‘dispute’❎ There often won’t be credible evidence to take action Dealing with neighbour disputes under an ASB policy is likely never to end positively: ‼️ Raised expectations, dissatisfaction and complaints ‼️ Increased tensions between parties ‼️ Time wasted trying to find an ASB solution that doesn’t exist What can you do?✔️ Triage reports ✔️ Be clear on your types of responses in these cases and the outcomes you are trying to acheive ✔️ Don’t manage cases under your ASB policy - concentrate on fostering good relationships.     I appreciate the chance to have participated in the EALS Institute training focused on managing Cross-Border Estates. A significant lesson I gained was the importance of adopting a comprehensive approach to cross-border estate management. This involves considering the legal framework of the client's country of domicile, understanding tax ramifications, evaluating the jurisdiction where assets are located, all while prioritizing the client's preferences.

    ❓What about your ASB procedure?I often talk about the inportance of your ASB policy, making sure it sets a solid foundation for clear, prompt and effective decisions. It also justifies your position to internal and external review (even more important with tighter regulation and increased awareness of the ASB Case Review) and helps manage expectations.Your ASB procedure is equally important, putting in place the practical steps to achieve the policy commitments.I frequently support organisations to create effective procedures.Given so many organisations will be (or should be!) reviewing their ASB procedure to ensure it helps achieve the most positive outcomes (hello, tenant satisfaction measures!) and promotes compliance with regulatory changes, I thought I'd share some common observations:1. Often I see procedures which cover points far better suited to the policy (or may be duplicated in both). Creates unnecessarily long documents, which dilutes the valuable bits, and risk of contradiction if one doc is revised without the other2. Lots of ASB procedures contain information that is better suited to a seperate guidance doc or process for use of individual enforcement powers. Keep the ASB procedure to case management steps/considerations to avoid it becoming difficult to navigate.3. Absolute statements of things that WILL be done in all cases. A good procedure should provide guidance and consistency of approach, whilst also allowing for professional judgements determined on the circs of each case.Hope this is helpful - shout up if it raises any questions!#ASB #ukhousing #procedures #consumerstandards #regulation #ASBcasereview

    Kanozi Mlotha (Adjudicator General) highlighted the importance of understanding what you are buying into. For example, if you don’t pay your levies it will result in disputes.     Ok, progress up date 🧐I have hit a brick wall that is as high as the hours are long it will fall at 9am when businesses open for business 😀I have requested my HMRC UTR for Bail Trust, I have been waiting over 1 years for HMRC to sort out my Vat number, I think its two years, I cant meet Due Diligence without ether one 😬I will have my insurance in place tomorrow and what I am rather excited about is our mentoring programme and the reason being its a part of Bail Trust that works along with the Site Training Centre & The Site Saftey Training Centre, trading names of Bail trust SSTC, STC,This is helpful as the certificates will say the construction trading names which is a bit more generic 💁♂️But I need to Ask, the MOJ have got so many programmes currently being delivered and working with ESFA, Why is the current recall rate as high as it is can anyone enlighten me ?I would like to hear voices of the professionals that are in partnership with the MOJ to deliver rehabilitation services , Could I request some data showing how well you are doing with your programme 🙂

    Careful how you structure property developments when your SMSF is involved.The ATO has released Taxpayer Alert TA 2023/2.It states that the they arereviewing arrangements under which one or more SMSFs have, or acquire, direct or indirect ownership of a special purpose vehicle (SPV) that undertakes a property development project and that because of the non-arm's length arrangements between the SPV and other entities, the SPV derives a profit that ultimately benefits the SMSFs which is more than what it would have been if all the parties had dealt with each other at arm's length.The ATO says that suchnon-arm's length arrangements have the effect of shifting what would otherwise be the profits of the related entities to the SMSFs, being concessionally taxed entities.Accordingly, the ATO says it will consider whether the dividends and other income received by the SMSFs are NALI and the application of the regulatory requirements in the SIS Act 1993 and other relevant law in respect of these arrangements.#ato #smsf #propertydevelopment #nali #accountants #advisors #virtualcfoservices
